The province is taking a pair of West Kelowna residents to court after seizing drugs, cash and a vehicle in a search warrant.

A Mercedes-Benz SUV and around $11,500 in cash were seized earlier this year and if the BC Civil Forfeiture Office is successful in court it will be taken by the province.

According to a July 14 notice of civil claim, an undercover Kelowna RCMP officer bought drugs from someone driving the SUV on Feb. 23 as part of an investigation that launched last November. The vehicle was seen then driving to 1887 Scott Road in West Kelowna.

Two days later, RCMP officers armed with a search warrant raided the house and residents Neil Collins and Patty Gianakos were arrested.

They took the $11,514 in Canadian cash, two firearms, ammunition, a bullet-proof vest and various amounts of drugs. The civil forfeiture office’s list also notes that one firearm was stolen and there was an unspecified amount of foreign currency.

The SUV wasn’t found until March 3. It’s not clear where, but the 2011 Mercedes-Benz ML350 was unoccupied and seized from the roadside. Police found cocaine and methamphetamine inside, according to court documents.

Neither Collins, who owns the vehicle, nor Gianakos have been criminally charged in relation to the search and they have not responded in court.

The civil forfeiture office’s claims have not been proven in court.
