The developer of two apartment buildings on Elliot Road is suing the City of West Kelowna for almost $300,000.<\/p>\n
The money is to pay the city’s share of road, sewer, water and drainage work that WestUrban Developments Ltd. was required to build on Gosset and Elliott roads in order to get the apartment complex approved.<\/p>\n
The agreement was reached in 2018 and WestUrban sent the city a bill on March 31, 2021.<\/p>\n
“To date and despite demand, the City has failed or refused to pay the invoice,” states the claim filed in B.C. Supreme Court yesterday, March 30.<\/p>\n
The court filing says the apartment complex is at 3641 Elliott Road in West Kelowna. Orchard Walk is listed on WestUrban’s website and described as two four-storey apartment buildings with 140 rental units.<\/p>\n
Last August, Ironclad Developments filed a claim against the city for almost $750,000 in latecomer fees for its four Lakeview Pointe apartment buildings at 3623 Elliott Road.<\/p>\n

Elliott Road Limited Partnership, which owned the property, has co-filed the claim.<\/p>\n They are asking for the $291,534.60 to be paid, with interest.
