{"id":7837,"date":"2026-02-19T04:00:00","date_gmt":"2026-02-19T12:00:00","guid":{"rendered":"https:\/\/infonews.ca\/?p=7542157"},"modified":"2026-02-18T16:53:27","modified_gmt":"2026-02-19T00:53:27","slug":"cruel-bc-landlord-who-made-life-harder-for-disabled-tenant-ordered-to-pay-100000","status":"publish","type":"post","link":"https:\/\/infonews.ca\/inhome\/news\/7837\/cruel-bc-landlord-who-made-life-harder-for-disabled-tenant-ordered-to-pay-100000\/","title":{"rendered":"&#8216;Cruel&#8217; BC landlord who made life harder for disabled tenant ordered to pay $100,000"},"content":{"rendered":"\n<p>A BC landlord who purposely engaged in a \u201ctargeted campaign of discrimination\u201d against a disabled tenant in an effort to have them move out has been ordered to pay $100,000 in compensation.<\/p>\n\n\n\n<p>The BC Human Rights Tribunal said that Wayne and Diana Rosso \u201ccruelly\u201d isolated a \u201cvulnerable, disabled senior\u201d and showed complete indifference&nbsp;to their behaviour.<\/p>\n\n\n\n<p>\u201cThe (Rosso\u2019s) showed no empathy or remorse for their treatment of Ms. Lloyd, openly admitting they would have continued their discriminatory conduct and retaliation until her tenancy ended,\u201d the Tribunal said in a Jan. 8 decision.<\/p>\n\n\n\n<p>\u201cThe nature of discrimination and retaliation in this case was severe, prolonged, continuous, and escalating. The (Rosso\u2019s) failed to accommodate Ms. Lloyd\u2019s disability-related needs for almost two years. Instead of implementing simple, cost-free or low-cost accommodations, (they) initiated a relentless, escalating campaign targeting Ms. Lloyd for adverse treatment because of her disabilities, and retaliated against her for asserting her rights,\u201d the Tribunal said.<\/p>\n\n\n\n<p>Over the course of two years, the Rosso\u2019s threatened and intimidated Catherine Lloyd and her guests, took over her parking spot, barred her from the laundry room, and attempted to evict her on multiple occasions.&nbsp;<\/p>\n\n\n\n<p>When Lloyd said she was filing a Human Rights complaint, the couple retaliated by turning off her heating.<\/p>\n\n\n\n<p>The decision said Lloyd had rented her Lower Mainland basement suite for four years from Fernanda\u00a0Almeida, before the upstairs tenants moved out and Almeida\u2019s daughter Diana\u00a0Rosso and her husband Wayne Rosso moved in. Almeida was hands-off and Wayne became the de facto landlord.<\/p>\n\n\n\n<p>The decision didn\u2019t say where in the Lower Mainland the situation took place, but the regulator lists Diana as a licensed practical nurse at Burnaby Hospital, and Wayne\u2019s LinkedIn page said he works at Strive Living Society.<\/p>\n\n\n\n<p>The decision said Lloyd has progressive knee osteoarthritis and has lived with it for more than 20 years. She walked with a cane and used a mobility scooter. She was forced to stop working in 2018 because of her health.<\/p>\n\n\n\n<p>Lloyd didn\u2019t sign a written tenancy agreement but over the years it was arranged with the upstairs tenants that she could park her car in the driveway, so it was closer to the front door; park and charge her motorized mobility scooter in the garage; and have&nbsp;flexible access to the shared laundry room. She also stored some of her belongings in a crawl space and the laundry room.<\/p>\n\n\n\n<p>However, when the Rosso\u2019s moved in, everything changed.<\/p>\n\n\n\n<p>The couple barred her from parking on the driveway and restricted her use of the laundry room to Monday only.<\/p>\n\n\n\n<p>She asked for more access to the laundry room because she couldn\u2019t guarantee her health would be good enough on a Monday to do her laundry.&nbsp;<\/p>\n\n\n\n<p>However, the Rosso\u2019s refused.<\/p>\n\n\n\n<p>The matter ended up at the Residential Tenancy Branch, which ruled that laundry access had to be given four days a week.<\/p>\n\n\n\n<p>\u201cThe (Rosso\u2019s) unlocked the laundry room door on the first two consecutive Mondays. It remained locked the remainder of the days,\u201d the decision reads.<\/p>\n\n\n\n<p>The Rosso\u2019s barred Lloyd from leaving her mobility scooter in the garage and said she could charge it at the back of the house. This meant lifting it over a step. Garage bins were then placed at the back of the house, which meant the scooter&#8217;s charging cord couldn\u2019t reach the outlet.<\/p>\n\n\n\n<p>The couple also ordered her to move her belongings from the crawl space and laundry room. They then inspected Lloyd\u2019s home and told her she had 40 days to clear up the \u201cclutter.\u201d<\/p>\n\n\n\n<p>They made unreasonable demands on their disabled tenant and 40 days later issued an eviction notice, citing the place was still in \u201cutter chaos\u201d and claiming she was a hoarder.<\/p>\n\n\n\n<p>However, the Residential Tenancy Board ruled the couple hadn\u2019t proven any element&nbsp;of their eviction notice.&nbsp;<\/p>\n\n\n\n<p>The Tribunal ruled the couple \u201cmanufactured the environment\u201d as the premise of their eviction attempt.<\/p>\n\n\n\n<p>\u201cTheir demand that she purge her belongings and declutter to their standards in an arbitrary amount of time reflects what little regard they had to accommodate her disabilities,\u201d the Tribunal ruled.<\/p>\n\n\n\n<p>The decision gave a long list of the couple&#8217;s behaviour.<\/p>\n\n\n\n<p>They put cameras with speakers around the property and would use them to communicate with Lloyd when she was outside.<\/p>\n\n\n\n<p>A support worker said Wayne harassed him.<\/p>\n\n\n\n<p>\u201cHe also called and threatened to file lawsuits against various organizations that advocated and supported Ms. Lloyd,\u201d the Tribunal said.<\/p>\n\n\n\n<p>Lloyd set up a chair and table at a halfway point between walking from her car to her front door, but Wayne wouldn\u2019t allow it.<\/p>\n\n\n\n<p>\u201cIn doing so, they created disability related barriers in her tenancy,\u201d the Tribunal ruled.<\/p>\n\n\n\n<p>After almost two years with the Rosso\u2019s living above her, Lloyd moved out.<\/p>\n\n\n\n<p>The decision gave a play-by-play account of what took place and how the Rosso\u2019s made her life more difficult.<\/p>\n\n\n\n<p>At the Human Rights hearing, Wayne testified that he would have continued his conduct until Lloyd was evicted.<\/p>\n\n\n\n<p>\u201cThis tribunal cannot tell me how to live my life. I live it the best way I can, and I cannot change my whole life to accommodate this,\u201d Wayne told the Tribunal, calling the case a \u201clegal scam\u201d and\u00a0accusing Lloyd&#8217;s lawyers of \u201clying to her to make money off of her.\u201d<\/p>\n\n\n\n<p>However, the Tribunal strongly disagreed and ordered he pay $10,000 in costs because of his behaviour.<\/p>\n\n\n\n<p>The Tribunal found Wayne had lied under oath and gave numerous examples.<\/p>\n\n\n\n<p>\u201c(Wayne) repeatedly made unfounded accusations, smears, and invectives against Ms. Lloyd and her counsel, made impertinent remarks directed to the Tribunal during the hearing, and gave false testimony,\u201d the decision reads.<\/p>\n\n\n\n<p>The Tribunal said the Rosso&#8217;s were aware of Lloyd&#8217;s disability, and did nothing to accommodate her.<\/p>\n\n\n\n<p>\u201cI have no issue finding Ms. Lloyd was particularly vulnerable to the (Rosso\u2019s) discrimination due to her disability and low income,\u201d the Tribunal ruled.<\/p>\n\n\n\n<p>Ultimately, the Tribunal ordered Almeida and the Rosso\u2019s pay Lloyd $60,000 as compensation for injury to her dignity, feelings, and self respect, along with $30,596.17 as compensation for expenses, plus the $10,000 for Wayne\u2019s conduct at the Tribunal.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Human Rights Tribunal said the landlords knew about their tenants disability and did nothing to accommodate her.<\/p>\n","protected":false},"author":292,"featured_media":7838,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"guid":"","source":"","byline":"","published":"","updated":"","_infotelid":"","_prepressid":"","_multisite_post_sync":"","_jetpack_memberships_contains_paid_content":false,"footnotes":""},"categories":[1680,541,543],"tags":[],"region":[322,323,324,325],"class_list":["post-7837","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-featured","category-local","category-topnews","region-kamloops","region-kelowna","region-penticton","region-vernon"],"blocksy_meta":[],"parsely":{"version":"1.1.0","canonical_url":"https:\/\/infonews.ca\/inhome\/news\/7837\/cruel-bc-landlord-who-made-life-harder-for-disabled-tenant-ordered-to-pay-100000\/","smart_links":{"inbound":0,"outbound":0},"traffic_boost_suggestions_count":0,"meta":{"@context":"https:\/\/schema.org","@type":"NewsArticle","headline":"&#8216;Cruel&#8217;
