{"id":5381,"date":"2026-04-04T04:00:00","date_gmt":"2026-04-04T11:00:00","guid":{"rendered":"https:\/\/infonews.ca\/inwheels\/news\/5381\/kelowna-motorcyclist-films-himself-speeding-incriminates-himself-ends-up-behind-bars\/"},"modified":"2026-04-04T04:00:13","modified_gmt":"2026-04-04T11:00:13","slug":"kelowna-motorcyclist-films-himself-speeding-incriminates-himself-ends-up-behind-bars","status":"publish","type":"post","link":"https:\/\/infonews.ca\/inwheels\/news\/5381\/kelowna-motorcyclist-films-himself-speeding-incriminates-himself-ends-up-behind-bars\/","title":{"rendered":"Kelowna motorcyclist films himself speeding, incriminates himself, ends up behind bars"},"content":{"rendered":"\n<p>A Kelowna motorcyclist with a penchant for extreme speeds and lengthy wheelies has found out that filming your every move isn\u2019t wise.<\/p>\n\n\n\n<p>The motorcyclist had evaded capture, but when police finally caught up with him months after receiving their first complaint, his GoPro camera provided them with all the evidence they needed.<\/p>\n\n\n\n<p>Instead of a single ticket for excessive speed or dangerous driving, Christopher Blair Muir\u2019s video footage provided police with weeks of his reckless driving antics.<\/p>\n\n\n\n<p>On March 30, Muir appeared in a Kelowna courtroom from custody as Crown prosecutor Catherine Rezansoff&nbsp;read out a lengthy list of Muir&#8217;s driving offences.<\/p>\n\n\n\n<p>\u201cHe travels at 253 kilometres per hour in a 60 kilometres per hour zone,\u201d the Crown told the court. \u201cThe GoPro captures the speed at Glenmore Road near Union Road.\u201d<\/p>\n\n\n\n<p>The prosecutor continued.<\/p>\n\n\n\n<p>\u201cHe drives over 180 kilometres per hour in the north end of downtown Kelowna, 184 kilometres per hour on Wendell Place, which is a 50 kilometres per hour posted speed. He travels at 194 kilometres per hour on Richter Street between Wendell Place and Cambridge Avenue,&#8221; Rezansoff said.<\/p>\n\n\n\n<iframe loading=\"lazy\" src=\"https:\/\/www.facebook.com\/plugins\/video.php?height=476&#038;href=https%3A%2F%2Fwww.facebook.com%2Freel%2F903777961385765%2F&#038;show_text=false&#038;width=267&#038;t=0\" width=\"267\" height=\"476\" style=\"border:none;overflow:hidden\" scrolling=\"no\" frameborder=\"0\" allowfullscreen=\"true\" allow=\"autoplay; clipboard-write; encrypted-media; picture-in-picture; web-share\" allowFullScreen=\"true\"><\/iframe>\n\n\n\n\n\n<p>At one point, he stopped for a burnout on Poplar Point Drive.<\/p>\n\n\n\n<p>\u201cHe does wheelies at 123 kilometres per hour on Manhattan Drive,\u201d the Crown said. \u201cAnd both streets are narrow and in close proximity to a large number of residential high-rises.<\/p>\n\n\n\n<p>\u201cHe does wheelies at high speeds on Ellis Street, north of Clement Ave, and then returns to his residence.&#8221;<\/p>\n\n\n\n<p>Police were waiting for him when he got home, and he wasn\u2019t pleased to see them.<\/p>\n\n\n\n<p>\u201c(He) said he wasn\u2019t driving a motorbike, then resisted arrest,\u201d Rezansoff said.<\/p>\n\n\n\n<p>Wearing an armoured motorcycle jacket and a full-face motorcycle helmet made his arrest difficult.&nbsp;<\/p>\n\n\n\n<p>Muir put up a lot of resistance and didn\u2019t stop after being told he would be tasered. The struggle landed him and the officer inside his apartment, where Muir protested that now that he was at home, he couldn\u2019t be arrested.&nbsp;<\/p>\n\n\n\n<p>Finally, he was pinned down and handcuffed.<\/p>\n\n\n\n<p>The RCMP found a knife and brass knuckles on him, along with some individually wrapped packages of suspected drugs.&nbsp;<\/p>\n\n\n\n<p>And it was all captured on his GoPro.<\/p>\n\n\n\n<p>There was no explanation given in court as to why it took so long, the incidents happened in 2022, but last year Muir was charged with resisting arrest, possessing a knife, and four counts of dangerous driving. There was no mention of any drug-related charges in court.<\/p>\n\n\n\n<p>Police used Muir\u2019s GoPro footage \u2013 which he also posted to Facebook and TikTok \u2013 to secure charges for much of the evidence presented in court.<\/p>\n\n\n\n<p>The Crown prosecutor said when Muir looked down, the helmet-mounted camera clocked the motorbike&#8217;s speedometer.<\/p>\n\n\n\n<p>In the years since the incidents, Muir had lost his licence and been banned from driving.<\/p>\n\n\n\n<p>Muir pleaded guilty to resisting arrest and one count of dangerous driving.<\/p>\n\n\n\n<p>However, after underscoring the dangers of Muir\u2019s driving, the Crown prosecutor put forward a joint submission with the defence for three months&#8217; jail.<\/p>\n\n\n\n<p>It didn\u2019t impress Provincial Court Judge Monica McParland, who called the suggested sentence \u201cway low.\u201d<\/p>\n\n\n\n<p>\u201cTell me how three months is appropriate,\u201d the judge said sternly. \u201cDo your best. You&#8217;re on notice.\u201d<\/p>\n\n\n\n<p>In Canada, judges largely have to follow joint submissions except in extreme circumstances. Judge McParland said she was concerned about the submission.<\/p>\n\n\n\n<p>The Crown relayed how some of the evidence was circumstantial, and the guilty plea meant police wouldn\u2019t have to authenticate all of the speed limits seen in the video.<\/p>\n\n\n\n<p>Rezansoff also pointed out that much of Muir&#8217;s driving was done safely, and he hadn\u2019t been speeding the entire time.<\/p>\n\n\n\n<p>&#8220;I don\u2019t care,\u201d the judge said. \u201cThat\u2019s not mitigating, this is not somebody who accidentally is going downhill on the Coquihalla and for a moment goes 160 km\/h.\u201d<\/p>\n\n\n\n<p>Defence lawyer Michael Stevenson made his case, stating Muir slowed down for other vehicles and was always shoulder-checking.<\/p>\n\n\n\n<p>\u201cThe wheelies are not&nbsp;long-duration wheelies,\u201d the defence lawyer said.&nbsp;<\/p>\n\n\n\n<p>&#8220;But they&#8217;re done in residential areas,\u201d the judge replied.<\/p>\n\n\n\n<p>The defence lawyer said the 39-year-old was remorseful, and since the incidents, had leart better.<\/p>\n\n\n\n<p>\u201cIt&#8217;s an interesting case.&nbsp;It&#8217;s really hard to find cases on point&nbsp;because most people don&#8217;t film themselves speeding,\u201d the defence lawyer said.<\/p>\n\n\n\n<p>When asked if he wanted to say anything, Muir didn\u2019t help his case.<\/p>\n\n\n\n<p>\u201cThe calibration&nbsp;of my speedometer&nbsp;on that motorcycle&nbsp;was&nbsp;way off,\u201d Muir told the judge.<\/p>\n\n\n\n<p>He said changing the sprockets and the tire size affects the speedometer.<\/p>\n\n\n\n<p>\u201cBecause some of these&nbsp;speeds,&nbsp;they&#8217;re even shocking&nbsp;to me&nbsp;because I know for a fact\u2026 I don&#8217;t have the&nbsp;skill level&nbsp;to be doing wheelies&nbsp;at these speeds,\u201d he said.<\/p>\n\n\n\n<p>Judge McParland wasn\u2019t impressed, pointing out that Muir was either pleading guilty and admitting to the facts, or he wasn\u2019t.<\/p>\n\n\n\n<p>Muir quickly said he was admitting to the facts.<\/p>\n\n\n\n<p>While the judge\u2019s decision to accept the joint submission would have likely seen Muir released that day on time served, McParland said she had \u201cbad news\u201d for everyone.<\/p>\n\n\n\n<p>\u201cI&#8217;m not&nbsp;giving a decision today,\u201d the judge said.<\/p>\n\n\n\n<p>The case was adjourned,
