The Latest: Judge sets hearing for ex-motorcycle gang boss

RENO, Nev. – The Latest on a hearing to determine if an ex-motorcycle gang leader will be tried a second time for killing a rival gang member during a casino shootout in 2011(all times local):

2 p.m. Wednesday

More than five months after the Nevada Supreme Court overturned his murder conviction, a judge has set an arraignment for an ex-motorcycle gang leader to be tried a second time for killing a rival gang member during a casino shootout in 2011.

Washoe District Judge Connie Steinheimer ordered 58-year-old Ernesto Gonzalez on Wednesday to return to her courtroom to enter a plea at an arraignment June 23.

Steinheimer sentenced the former head of the Nicaraguan chapter of the Vagos gang to up to life in prison after his conviction in October 2013 for the fatal shooting of Jeffrey Pettigrew at a hotel-casino in Sparks.

Pettigrew was the president of the Hells Angels in San Jose, California.

The Supreme Court threw out Gonzalez’s earlier conviction in December based partly on faulty instructions to the jury.

Five months after the Nevada Supreme Court overturned his murder conviction, an ex-motorcycle gang leader is headed back to court in Reno to determine if he’ll be tried a second time for killing a rival gang member during a casino shootout in 2011.

Washoe District Judge Connie Steinheimer had sentenced 58-year-old Ernesto Gonzalez to up to life in prison after his conviction in October 2013 for the fatal shooting of Jeffrey Pettigrew at a hotel-casino in Sparks.

Gonzalez was the head of the Nicaraguan chapter of the Vagos, and Pettigrew was the president of the Hells Angels in San Jose, California.

Gonzalez is scheduled to appear in court Wednesday morning for a hearing on a motion for a retrial made by Washoe County prosecutors.

The Supreme Court threw out his earlier conviction in December based partly on faulty jury instructions.
