Ashcroft murder trial remains stalled

KAMLOOPS – The trial for an Ashcroft man accused of killing his uncle remains in limbo as court awaits results of a psychiatric assessment.

Shane Takeshi Gyoba is charged with one count of second-degree murder in the death of Ed Gyoba, his uncle whom he lived with in Ashcroft.

The trial began in August but halted after his lawyer requested Gyoba receive a psychiatric assessment. Lawyers will fix a date next month to resume the trial.

Results of the assessment will be disclosed at trial. From there a judge will decide on a verdict. If Gyoba is convicted, his lawyer may seek to prove he was not criminally responsible because of a mental disorder.
