Lengthy probation for Osoyoos man sentenced for indecent exposure

PENTICTON – An Osoyoos man faces three years probation for two counts of indecent exposure.

Brian Arthur Jones pled guilty in a Penticton courtroom this morning, Jan.18 to committing an indecent act in a public place for two incidents that occurred in August, 2015.

Crown Prosecutor Catherine Crockett told court Jones was reported to police on August 12 at approximately 3 p.m. after a woman witnessed an older man with a white beard sitting on a rock near the beach at Haynes Point in Osoyoos. The man was naked and masturbating at the time, the witness said.

On August 12, police received another call, this time from a woman in Cottonwood Park. She witnessed an older male in the park, naked and masturbating while looking at her. She moved, and the man followed before leaving in a vehicle.

Police patrolled Osoyoos after receiving the woman’s description of the vehicle and located it at a pullout near the bridge crossing Osoyoos Lake. No one was inside, but witnesses said a man matching Jones’ description walked away from it.

Police had the vehicle towed, and on August 13, Jones was arrested when he appeared at the police station to find out how he could recover his vehicle.

Crockett told Judge Meg Shaw Jones was cooperative with police, and did not contest any of the charges against him.

Crockett also noted Jones’ prior history, having several previous, but dated convictions for similar types of behaviour. She said Jones had been able to control his impulses in the past with counselling, asking the judge for a suspended sentence with a long probation order and counselling condition, in addition to a “no go” order to public beaches.

Defence lawyer Kathryn Lundman told court Jones' psychiatric evaluation indicated he suffered from an Obessive Compulsive Disorder in addition to an exhibitionist disorder. She said her client seemed to respond to treatment in the past. His last related offence was in 1998.

Judge Shaw said she considered Jones’ case for some time before imposing a three-year probation, expecting Jones recognized he must have ongoing help. Among the conditions, he is not allowed near any public beach or swimming area in British Columbia and register as a sex offender.
