Ashcroft man guilty of murdering uncle ordered to undergo psychiatric evaluation

KAMLOOPS – The Ashcroft man guilty of beating his uncle to death with a shovel will need to undergo a psychiatric evaluation.

Shane Takeshi Gyoba was found guilty of second degree murder in Kamloops Supreme Court yesterday, June 23. Directly after the ruling, Crown prosecutor Neil Flanagan filed an application to have Gyoba's mental state assessed.

If Gyoba is found to have a mental disorder, he will be found not criminally responsible for the death of his uncle Ed Gyoba.

Gyoba was kicked out of the courtroom today, June 24, after interrupting Judge Dev Dley's decision several times. Throughout Gyoba's court proceedings, he's had several outbursts and has made violent threats.

"I have guns in this building. I can have you killed any time I want," Gyoba shouted at Dley.

After that, Gyoba appeared by video from the courtroom next door. Dley said he was not going to let Gyoba's outbursts affect his ruling.

"I have based my judgement only on his behaviour around the time of June 2, 2014," Dley said. "If there was ever a case where an assessment was required, it would be this."

Gyoba's next court appearance is expected to be by video next month.
