Wahoo! Town allows inflatable Mario back outside game store

ORANGE PARK, Fla. – A giant, inflatable Super Mario has picked up a green mushroom and earned another life outside a Florida video game store.

Attorneys for Gone Broke Gaming and the town of Orange Park, a suburb of Jacksonville, have reached an agreement that allows the 9-foot-tall (2.7-meter-tall) Mario to be out on display once again. Following mediation, the town’s attorney sent store owner Scott Fisher a letter on Tuesday saying Orange Park’s sign code had been suspended for the store while officials revise the existing rules.

Town officials cited Fisher last year, threatening him with fines if he didn’t remove the display.

Fisher filed a federal lawsuit in April arguing that the town’s ban violates free speech. Lawyers with the conservative law organization Institute for Justice were representing Fisher. They say Super Mario is already back outside the store.
