Not guilty verdict in fatal Cherryville crash

VERNON – It’s been over three years before the courts, but there is finally a decision in the dangerous driving causing death case in connection with a crash between a semi and pickup truck.

Lavington’s Terrance Edward Brown, 37, has been found not guilty of dangerous driving causing death and dangerous driving causing bodily harm, according to Global Okanagan.

Brown was behind the wheel of a Super B tractor trailer hauling wood chips that struck a Ford F350 pick-up carrying three people on April 28, 2011, about 40 kilometers east of Cherryville on Highway 6.

The occupants of the truck were Randy Duncan, 22, of Kamloops, a female passenger and an infant.

Duncan died at the scene, while the woman was rushed to hospital with serious but non-life-threatening injuries. The child, Kayleigh Duncan, was not injured.

In March, a B.C. Supreme Court judge awarded Kayleigh $560,000 for the loss of her father in the crash.

The lawsuit was against Brown and Brown’s employer DCT Chambers Trucking Ltd. of Vernon.
