Penticton RCMP officer charged in connection with crash that killed five-year-old

PENTICTON – A charge of driving without due care and attention has been approved against a Penticton RCMP officer involved in a collision almost a year ago that claimed the life of a five-year-old boy.

The Criminal Justice Branch announced the charge approval today, Sept. 9, in a media release.

On Sept. 15, 2015, Const. Ace Stewart was involved in a collision at Fairview Road and the Channel Parkway in Penticton. It is alleged Stewart, who was off duty at the time, struck and killed five-year-old James Christian McIntosh.

The Independent Investigations Office of B.C. conducted an investigation and determined the officer may have committed an offence.

The report resulting from the investigation was handed over to the Criminal Justice Branch and the charge was approved.

The single charge was sworn against Stewart in a Penticton court today and his next court appearance is scheduled for Oct. 12.
