Suspended Penticton driver sees the light following dual convictions

PENTICTON  – A Penticton woman who “took the cure” according to her lawyer received a day in jail and a year of probation in court yesterday.

Jennifer Mary Mableym, 30, entered guilty pleas to two counts of driving while license suspended in Penticton court, Feb. 28.

Crown prosecutor Ann Lerchs said Mabley was driving in Kelowna on Oct. 27, 2015 when she was stopped by Kelowna RCMP who discovered her license was suspended.

On Feb. 23, 2016, Mabley was pulled over in Okanagan Falls after police discovered the plates on her vehicle belonged to a different vehicle. Further investigation revealed she was a suspended driver.

Lerchs noted Mabley’s lengthy list of past driving convictions, including her last conviction that carried a 14 day jail sentence, when she asked Judge Gale Sinclair for a total of 44 days jail time for the two new offences.

Defence lawyer James Pennington said his client, who was pregnant at the time of the last offence, had “completed the 180 we’re all looking for.” He said his client had enrolled in a treatment program and had done very well.

“She took the cure,” he said, asking the judge to consider a community sentence.

Sinclair noted Mabley’s pre-sentence report was positive, calling her a low risk to reoffend if she continues the path she’s on. The report also called Mabley insightful, motivated and grateful for the support she had received.

The judge sentenced Mabley to one day in jail followed by one year of probation. She will also lose her driving privileges for two years.
