EDMONTON – Alberta Justice says it will not appeal the verdict for an Alberta MP who was found not guilty of failing to provide a breath sample during a police checkstop.

A provincial court judge ruled Peter Goldring didn’t intend to avoid taking a breath test, but was simply asking the police questions that any person in his situation would have asked.

The judge concluded that Goldring’s decision not to blow wasn’t conscious or wilful.

Goldring had been sitting as an Independent since being charged in the December 2011 stop.

On Thursday, Prime Minister Stephen Harper said Goldring is being welcomed back into the Conservative caucus.
