LA CROSSE, Wis. – A Wisconsin man will voluntarily return to Arizona to be re-tried on allegations he killed his son in 2004.
Authorities say 51-year-old Jeffrey Martinson, of La Crosse, agreed Friday to waive extradition. He will be transported to Maricopa County in Arizona.
Martinson is accused of giving his 5-year-old son a lethal dose of prescription drugs, after which Martinson tried to kill himself. Defence attorneys have argued that Martinson’s son may have taken the drugs himself and Martinson tried to kill himself because he was distraught.
Martinson was found guilty of first-degree murder in 2013. A Maricopa County judge overturned the conviction because of juror misconduct and ordered a new trial. The case was later dismissed over prosecutorial misconduct.
The Arizona Court of Appeals ruled in 2016 to reinstate the charges.
