Authorities have ‘luxury estate’ vacation rental near Penticton in crosshairs

PENTICTON – A prestigious property currently listed on Airbnb is facing possible injunctive action by the regional district.

The property, located at 320/328 Highway 3A west of Kaleden, underwent renovations earlier this year, apparently without a permit, that were recently discovered by the Regional District of Okanagan Similkameen’s building department.

A “Do not occupy” notice was placed on the front gate and on the dwelling itself and a letter sent to the registered owner advising of the notice and requirements needed to obtain a building permit.

A report prepared for the regional district board of directors meeting on Thursday, Sept. 20 notes the owner has not responded to the regional district since, with a final notice sent to the owner on Aug. 23.

The property is listed on the Airbnb website as the Marron River Ranch & Vineyard, containing five bedrooms, eight beds and six baths.

It is billed as a “luxury estate, one of a kind, 6,700 square foot residence in 100 acres of breathtaking B.C. countryside and vineyard, with accommodations for up to 20 guests.”

The residence rents out for $1,007 per night.

Staff's report says the property, which is advertised on several vacation websites, has not been issued a temporary use permit for a vacation rental.

Regional District Development Services Manager Brad Dollevoet says whenever a property owner converts previously unliveable space to living area they are subject to a building permit. He says the regional district recently found out about the renovations and has no record of a permit being issued.

The report prepared for council says the property has a restrictive convenant regarding use of the fourth floor but photos show it was converted into living space.

Regional district staff interpret the infraction as a category three deficiency, posing health and safety concerns requiring a notice on title and compliance through injunctive action.

Dollevoet says the regional district probably has several residences being operated as vacation rentals without permits. He says action is taken when the district discovers them. 

Regional district staff are recommending the board place a notice on title and seek a court-ordered injunction on the property.
