Accused gangster’s lawyer asks for murder conspiracy charged to be dropped

VANCOUVER – The lawyer for an accused gang member on trial for the murder of six people near Vancouver says there is no evidence to show his client was involved in a conspiracy.

The lawyer for Cody Haevischer, who is also charged with six counts of first-degree murder, is asking a judge to drop the charge of conspiracy to commit murder.

Haevischer is on trial along with Matthew Johnston for a gangland execution that killed six people, including two innocent bystanders, in Surrey, B.C., in October 2007.

Defence lawyer Simon Buck says the Crown has failed to present any evidence that Haevischer was involved in planning or agreeing to any conspiracy.

Buck says the testimony of former gang members and Haevischer’s girlfriend make it clear that Haevischer was not present at three alleged meetings where the plot was discussed.

If the application is successful, it would not affect the murder charges against Haevischer or the murder and conspiracy charges against Johnston.
