ANDY WARHOL ESTATE WINS LAWSUIT OVER IMAGE OF PRINCE
NEW YORK (AP) – A photo of Prince that artist Andy Warhol turned into a series of artworks was at the centre of a lawsuit over whether changing its meaning constitutes fair use. U.S. District Judge John G. Koelti sided with the Andy Warhol Foundation for the Visual Arts, which was sued by renowned photographer Lynn Goldsmith. She took a photo of Prince in 1981 that she believed showed Prince vulnerable and uncomfortable. Vanity Fair magazine licensed the photo in 1984 and commissioned Warhol to use it for an illustration to accompany an article on Prince. Koelti said Warhol’s work with loud colours transformed the Prince image into “an iconic, larger-than-life figure” that’s instantly recognizable as a Warhol. Goldsmith had argued a 2016 publication of the art destroyed a high-profile licensing opportunity. Her lawyer plans to appeal.
