ICC judges call out Kenya for failure to co-operate

THE HAGUE, Netherlands – International Criminal Court judges have reported Kenya to the court’s governing body for failing to co-operate with investigators in the failed prosecution of the country’s president.

Prosecutors dropped their case against President Uhuru Kenyatta in 2014 for lack of evidence, saying Kenyan authorities repeatedly failed to co-operate fully with investigations.

Kenyatta had been charged with involvement in deadly violence that erupted after Kenya’s 2007 elections. He always insisted he was innocent.

Judges said Monday they were reporting Kenya to the court’s Assembly of States Parties “for the purpose of fostering co-operation more broadly” in possible future investigations in Kenya.

Human Rights Watch called on ICC member states to “make sure the message is heard in Nairobi that they will not turn a blind eye to the government’s obstruction of justice.”
