Jail for killing pedestrian? No, judge says house arrest instead

KAMLOOPS – A Kamloops man who struck and killed a 66-year-old woman in a crosswalk will serve his sentence at home instead of jail after a judge overturned his original six-month jail sentence on Friday, Feb. 13.

At an appeal hearing in Kamloops Supreme Court, Justice Alison Beames granted Donald Charles Isadore his appeal and substituted a nine-month sentence—three months under house arrest and the remainder under a 7 p.m. to 7 a.m. curfew.

Isadore was originally sentenced to six months in jail after his conviction for failure to yield to pedestrian Valerie Brook in November 2012. The 66-year old was killed in the crosswalk after she was struck by Isadore’s truck.

Before this appeal, he spent 44 days of that sentence at the Kamloops Regional Correctional Centre. The time served has been credited to his new sentence.

Isadore has never held a drivers licence. Following Brook’s death, he was found driving again on two separate occasions.

“These were calculated decisions (to drive),” Crown prosecutor Monica Fras said.

Isadore’s lawyer, Kevin Walker, argued his client’s history in the residential schools was not considered in Judge Stella Frame’s original sentence.

The three-year driving prohibition Isadore received in his initial sentence remains in effect.

  1. I don’t care what colour his skin is. Tha fact that he KILLED someone he should go to JAIL. What is the matter with the judge giving such a stupid sentence? I agree with Stephan Fedoriw evey word he says is true. About time Kamloops takes a look at what we can get away with.

    A petition should be drafted for signatures to have this miserable excuse for a judge removed from the bench before he allows another killer in control of a dangerous weapon go free again.

  5. The sentence for this repeat offender is not suffient for the crime committed. An appeal would be in order as well as a civil lawsuit.

    Whether or not this man is Native or Non Native, he still did not ever obtain a drivers license in his life.He knew it is wrong to drive a vehicle illegally…He also drove through a red light (He doesn, t know how to drive!) and didn, t see the woman he struck with his truck and killed her. This is Murder! Why wasn, t he charged with manslaughter? What is wrong with the Police? Too much paper work for a serious murder charge? And the judge? Too much legal forms to put him in The pen for life?Or is it because the female victim was Native as well? She was a Nurse about to retire and is now missed by her Husband and family! House Arrest? What a joke!

    I worked with this lovely lady, and was heart breaking to the family!This man has many DUIs and driving suspensions and ignored each and every one of them!He doesnt care for anyone vut himself and house arrest kust means he will drive again as soon as runs out of beer or needs to hit the casino again!Hes self entitled and doesnt give one rats petunia that hes putting others in jeproday being behind a wheel!Hes a repeat offender and will keep on doing it!What a horrible slap in the face for the victims family and a total slap in the face to the people of Kamloops who are and have been waiting and hoping to see this guy get some justice!To the judge, you failed BIG TIME, THANKS FOR NOT DOING YOUR JOB PROPERLY!
