B.C. man gets 18 months and probation for the drunk driving death of a boy

KELOWNA, B.C. – A man convicted of killing a six-year-old boy while driving drunk has been handed an 18-month jail term and two years probation.

Last November, 22-year-old Cody Wengenmayr was found guilty of killing Trey Alphonse and injuring his mother, Iris, as they jaywalked across Highway 97 in Kelowna.

B.C. Supreme Court Justice Gregory Bowden also handed him a one-year jail sentence for injuring the boy’s mother, but that will be served at the same time as the 18-month term.

Bowden said Wengenmayr’s previous drunk driving suspension and vehicle impoundment was an aggravated factor in sentencing.

The man, who will be eligible for parole in a year, has also been given a two-year driving ban.

Wengenmayr was still a novice driver at the time of the crash on Aug. 30, 2010, and by law, wasn’t allowed to have any alcohol in his system while driving. (CKFR)
