Kelowna nurse suspended after checking health record of potential nanny

A Kelowna nurse has been issued a temporary suspension after she accessed the personal health record of a person who she was considering hiring as a nanny.

According to a British Columbia College of Nurses and Midwives decision, registered nurse Megan Angel Munoz accessed the personal health records of two individuals in the summer of 2021.

The decision says Munoz had no professional relationship with the individuals and therefore no reason to check their records.

"She accessed the personal health records of two individuals with whom she had no therapeutic relationship without their knowledge or consent, for the sole purpose of obtaining their health information to inform an employment decision regarding hiring one of the individuals as a nanny," the decision says.

The decision isn't clear on the reason why Munoz checked the second individual's record but says it was for "clinical practice concerns identified while orientating to public health practice."

According to the Mar. 29 decision, Munoz signed a consent agreement with the College in which she voluntarily agreed to a three-week suspension and to complete professional ethics and boundaries education.

The decision also says Munoz will have to complete a "regulatory practice consultation program" that will address the "foundational issues" of her conduct.

The British Columbia College of Nurses and Midwives decision gave no other information about the case.
