Hell’s Angel gives up on appeal
KELOWNA – Daniel McRae, one of the three Hells Angels associates convicted of beating to death a Kelowna father in front of his sons in 2011, is not going to appeal his sentence.
According to the Vancouver Sun, the victim's son, Kody Phillips, told Justice Mark McEwan that the attack on his father lasted only seconds, “but felt like forever.”
Kody told the court that after the attack, he ran to where his father lay bleeding and unconscious.
“He was seizuring,” he said. “He went white. His eyes rolled to the back of his head. I knew right there and then, he was done.”
McRae, who was 19 at the time, was given 42 months in jail for initiating a fatal attack on Dain Phillips, 51, after a disagreement with Phillips' son. McRae's older brother Matthew along with Anson Schell were also convicted and received sentences of three and a half years and three years respectively. Both have appeals scheduled for this fall.
According to a Vancouver Province report, Matthew McRae was released on a $200,000 surety pending his appeal while Schell remains in custody.
Two full patch members of the biker gang, Norman Cox and Robert Thomas,who wielded the bat and hammer that killed Phillips, pleaded guilty to manslaughter and were sentenced to 15 years in jail.
