High court OKs move to make generic Viagra
OTTAWA – The Supreme Court of Canada has granted a Canadian drug company’s challenge of the Viagra patent held by pharmaceutical giant Pfizer.
In a 7-0 decision, the court sided with Teva Canada in a case with big implications for users of erectile dysfunction drugs.
A Teva victory opens the door for the company to begin selling its owngeneric version of the drug.
In a previous Federal Court case, Teva unsuccessfully challenged Pfizer’s dominance of the erectile dysfunction drug patent.
That court rejected Teva’s request to introduce a generic version of the drug.
Pfizer’s Viagra patent expires in 2014.
