Police: Boy’s fatal beating over birthday cake followed a week of daily handcuffing

HAGERSTOWN, Md. – Police in Hagerstown, Maryland, say a 9-year-old boy who was fatally beaten for taking a birthday cake had been handcuffed up to three hours a day for a week before the final assault.

Charging documents released Tuesday say a doctor who examined Jack Garcia said his injuries were consistent with torture.

The documents detail second-degree murder and first-degree child-abuse charges against the boy’s mother, Oriana Garcia, and her brother, Jacob Barajas. They were arrested Monday. Bail for each is set at $5 million. Neither has a defence attorney listed in court records.

Garcia and Barajas told investigators the fatal injuries were inflicted by Garcia’s boyfriend, Robert Wilson. He’s being held on assault and child-abuse charges that were levelled before the boy died. His bail is set at $1 million.
