CALGARY – A Calgary woman facing a retrial for allegedly strangling her daughter sobbed at a hearing today to determine if it should go ahead.
Aset Magomadova (uh-SET’ MAG’-uh-muh-DOH’-vuh) broke down while her 911 call to police in 2007 was played in court.
Her distress prompted a brief delay.
Magomadova, who is 43, was brought into court on a gurney and her lawyers say she is dying of cancer and too ill to face another second-degree murder trial.
During the call to police, she is heard telling the dispatcher in a calm tone of voice that she had killed her daughter during a fight.
A second trial was ordered after the Crown appealed her conviction of manslaughter and the suspended sentence she received.
