TORONTO – The lawyer for a man found not criminally responsible for killing a Toronto police officer with a snow plow is asking for him to be detained at a mental hospital.

Both the lawyer for Richard Kachkar, 46, and the Crown attorney are jointly asking the Ontario Review Board to send Kachkar to Ontario Shores in Whitby, east of Toronto.

Kachkar was found not criminally responsible last month after a trial in the death of Toronto Police Sgt. Ryan Russell, 35.

The verdict means the jury believed the expert testimony of three psychiatrists that Kachkar’s psychosis rendered him unable to appreciate what he was doing when he hit and killed Russell in January 2011.

Now that Kachkar has been declared not criminally responsible he is under the purview of the review board, which is holding his initial hearing today.

The board can decide to detain Kachkar at a psychiatric hospital, or set him free with or without conditions.

If they order him detained, which is the most likely decision, Kachkar will have such hearings on an annual basis.
