NYC philanthropist Astor’s son, 89, to hear Thursday whether he must start prison term
NEW YORK, N.Y. – An 89-year-old heir could end up in prison after a court date on his 11th-hour bid for a new trial in a case that shook New York society.
Anthony Marshall is due in a Manhattan court Thursday. He was convicted in 2009 of plundering his mother’s fortune by exploiting her mental decline. She was philanthropist and socialite Brooke Astor.
He denies the charges.
After Marshall lost appeals, his lawyers filed papers Friday seeking a new trial. The request concerns a juror’s assertions that she was intimidated into a conviction.
She raised the claims before but just recently signed a sworn statement. Marshall’s lawyers say that development merits at least a hearing.
Depending on the judge’s decision, Marshall could stay free on bail or have to start serving his one-to-three-year prison term.
