Kruger-Allen given conditional sentence for his part in group assault outside a Penticton nightclub

PENTICTON – A Penticton man was given a conditional sentence today for his part in a group assault that took place in August of 2017.

Thomas Kruger-Allen faced sentencing for assault and breach charges in Penticton court this morning, July 22, for his actions as part of a group of four or five men who attacked a man leaving the former Mule nightclub after it closed on Aug. 12, 2017.

The man was punched and kicked and sustained injuries requiring stitches, in addition to a shattered nose and orbital bone.

Judge Andrew Tam adjourned the original sentencing hearing on July 12 to consider his decision, returning to Penticton court this morning.

The judge handed down a conditional sentence of four months, followed by 18 months of probation for the assault charge

Kruger-Allen also faces a curfew from 6 p.m. to 6 a.m. for the length of the sentence. He was also given a single day in jail for a charge of breach.

The Crown was seeking a six- to eight-month jail term for the offences while defence lawyer Norm Yates asked for time served of 30 days jail.

“You’ve got a long road ahead of you, sir I wish you well in that regard. You’ve got a lot of work to do. Good luck, “ the judge told Kruger-Allen after passing sentence.

Kruger-Allen is also facing charges of assault and sexual assault following an incident that took place on Okanagan Lake beach on May 4 this year. In that assault, a Penticton man suffered a severe head injury as a result of the attack.
