A man jailed for child porn now wants a smartphone

KAMLOOPS — A Kamloops man not yet finished serving his sentence for luring a child over the Internet and possessing child pornography was back before a judge Thursday seeking access to a smartphone.

And he may soon get it.

While Kamloops Provincial Court Judge Roy Dickey denied him access to a handheld computer, he allowed Matthew Green, 32, a chance to apply later.

Green was sentenced Nov. 25, 2013 to 90 days in jail, served on weekends and two years on probation. He was snagged after an FBI investigator found more than two dozen images on his office computer, some of them girls as young as four years old.

He told Dickey he struggles to keep a schedule with his phone. The local accountant and bookkeeper already got a special exemption to use a computer for work.

Crown lawyer Sarah Firestone said a smartphone is, essentially a computer and he has other options.

“People have used calendars and notes for thousands of years before smart phones were around,” she said. “[The application] isn’t before the court because he is no longer a risk… but for his convenience.”

Green completes his intermittent sentence until April 15, is still taking counselling and hasn’t begun treatment. Dickey said that means he is still a risk. Once that’s done, he will reconsider, he said.
