Penticton woman suing city after tripping on sidewalk

A woman tripped on a sidewalk in Penticton and now the city is getting sued.

Barbara May Schneiderat fell on a sidewalk on Backstreet Boulevard in Penticton on June 7, which resulted in injuries to her wrist and torso, and caused her emotional distress, according to a lawsuit filed Dec. 5.

Causing or contributing to the fall was the City of Penticton’s negligence, the civil suit claims. The city failed to repair or maintain the sidewalk, it was not designed and built for its intended use, and there are no warnings for users.

Schneiderat is seeking relief for her pain, suffering, loss of amenities, loss of enjoyment of life, emotional distress, lost income, loss of opportunity to earn income, loss of future income capacity, cost of care, loss of house maintenance capacity, special damages, as well as costs.

The City of Penticton hasn't responded to the claim. None of the allegations have been proven in court.

Last month, a pedestrian who was hit by a long boarder in Penticton filed a lawsuit against the city and the rider. A woman was hit by a long boarder on the Lakeshore Drive multi-use pathway.
