A Kelowna lawyer has been accused of working for a client who lacked the capacity to understand what was going on when dealing with a wills and estate matter.
Kelowna lawyer Kimberly Dawn Rule is scheduled for a hearing in front of the BC Law Society next spring, facing numerous allegations in her handling of the matter in 2022.
According to an Aug. 1 BC Law Society citation, Rule failed to properly assess the client’s capacity to retain and instruct her.
The regulator alleges Rule failed to provide her client with complete and accurate relevant information about the matter and failed to obtain and record instructions from her client.
The Law Society alleges that Rule should have declined to act for her client when she “knew or ought to have known” that the client lacked the capacity to retain and instruct her.
The Law Society citation doesn’t give any details about what took place, only that it was a wills and estates matter that happened in November and December 2022.
The Law Society says the allegations constitute professional misconduct.
Rule has been practicing in BC since 1994 and is listed as working for Sabey Rule LLP.
Her hearing is scheduled for four days in April 2026.
None of the allegations have been proven.
Rule did not respond to our request for comment.
